What Is a Marijuana Plant?

Whether a person is a patient, a caregiver, or a commercial license holder, they may wonder what a marijuana plant is.  The only definition in the law indicates that marihuana plant means any plant of the species Cannabis Sativa L.  This definition does not answer, for example, whether a cutting is a plant.

This very issue was litigated in Michigan, and the Court of Appeals found, on an issue of the first impression, that clone plants, which were portions of mature plants used to start new plants, were marijuana plants under Michigan Medical Marihuana Act (MMMA).

Caregiver Change Form

In order to apply for caregiver change, a person needs to fill out the application, mail this application and any applicable documents to the LARA Michigan Medical Marijuana Program, and pay the fee.

On the form, the person should specify a name change, address change, removing a patient, or requesting a replacement caregiver card. For these changes, they will need to fill out and sign the change form, provide a valid form of photo identification, and pay a $10 fee.

Patient Change Form

For the patient change form, the patient needs to do the same things as for the caregiver change form. In addition to these things, they need to specify a name change, address change, change of plant possession, removal of caregiver, request of replacement card, the addition of a caregiver, or the change of a caregiver.

MMMP Application

If someone is over the age of 18 and they want to apply to the Michigan Medical Marijuana Program, they should mail the fee, a completed application, and the relevant documents to the Michigan Medical Marijuana Program.

They should also make sure to fill out an application for a registry identification card. Then, pay the fee ($60 for a patient, $25 for a caregiver). Also, they should make sure to provide a copy of valid photo identification and the physician certificate form that has been signed by a doctor.

MMMP Minor Application

If a person is under the age of 18, they can still apply to the MMMP, but separate provisions will apply. They need to fill out the minor application for a registry identification card. They also need to pay the $85 application fee and provide proof of your Michigan residency.

Also, provide proof of legal guardianship or parentage, and two physician certification forms that have been filled out and signed.

Release for Disclosure of Information Form

To apply for release for disclosure of information, a person should fill out the form and get their signature notarized. They should also provide a copy of their driver’s license or their identification card. Then, they need to mail everything to the LARA Michigan Medical Marijuana Program.
