Answer: OWI is the Michigan-specific acronym for operating while intoxicated. It is generally and commonly across the country and across the state referred to as DUI or driving under the influence, even though specifically that acronym does not exist in Michigan law. OWI, in fact, is made up of two distinct and different theories of law, which means a prosecutor may attempt to prove the case one of two ways, or even both. First is OUIL, or driving under the influence, which is the common law theory. The second way is UBAL, or unlawful blood alcohol level, which is the statutory or per se theory.
